Terms & Conditions

Effective Date: December 12, 2025

Please read these Terms and Conditions ("Terms") carefully. They form a legally binding agreement between you ("User," "you," or "your") and Bytek LLC ("Bytek," "we," "our," or "us") governing your access to and use of the FlowDraw website, web and mobile applications, APIs, plug-ins, and any related services (collectively, "FlowDraw" or the "Service").

1. Acceptance of Terms

By creating an account, accessing, or using FlowDraw, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Service.

2. Eligibility

You must be at least 13 years old (or the age of digital consent in your country, whichever is higher) and have the legal capacity to enter into contracts. If you use FlowDraw on behalf of an organization, you represent that you have authority to bind that entity to these Terms.

3. Account Registration & Security

  • You agree to provide accurate, current, and complete information during signup and to keep it updated.
  • You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

4. Subscription Plans & Billing

  • FlowDraw offers Free, Pro, and Team plans with the features and limits described on our pricing page.
  • Paid plans are billed in advance on a recurring basis (monthly or annually). All fees are non-refundable except as required by law.
  • You authorize Bytek (or its payment processor) to charge your designated payment method until you cancel. You may cancel anytime; features remain active until the end of the current billing period.

5. License & Intellectual Property

  • Our IP. FlowDraw, including all software, designs, trademarks, and content provided by Bytek, is owned by or licensed to Bytek and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use FlowDraw in accordance with these Terms.
  • Your IP. You retain all rights to flowcharts, documents, images, prompts, and other content you create or upload ("User Content").
  • License to Bytek. You grant Bytek a worldwide, royalty-free license to host, display, process, and transmit User Content solely to operate and improve FlowDraw.

6. AI Features & Generated Output

FlowDraw's AI Flowchart Generator and related features use machine-learning models that may occasionally produce inaccurate or inappropriate output. You acknowledge and agree that:

  1. AI output is provided "AS IS" for informational purposes only.
  2. You are solely responsible for verifying accuracy and ensuring compliance with all laws, regulations, and third-party rights before relying on or distributing any AI-generated content.
  3. Bytek disclaims all liability arising from your use of AI output.

7. Prohibited Activities

You may not:

  • Reverse engineer, decompile, or attempt to extract source code.
  • Upload or share content that is unlawful, hateful, defamatory, obscene, or infringes others' rights.
  • Interfere with or disrupt servers or networks connected to FlowDraw.
  • Use FlowDraw to develop or train AI models without our express written consent.
  • Rent, sell, sublicense, or otherwise exploit FlowDraw except as expressly permitted.

8. Privacy & Data Protection

Your use of FlowDraw is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By accessing or using the Service, you agree to the terms of the Privacy Policy, as it may be updated from time to time.

9. Third-Party Services

FlowDraw may integrate with third-party services (e.g., Supabase, payment processors). Your use of those services is governed by their respective terms, and Bytek is not responsible for their acts or omissions.

10. Termination

  • You may stop using FlowDraw at any time.
  • We may suspend or terminate your access immediately if you violate these Terms, create risk or legal exposure, or fail to pay fees when due.
  • Upon termination, your license ends and you must cease all use of FlowDraw, but Sections 5, 6, 9-14 survive.

11. Disclaimers

FLOWDRAW IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, BYTEK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BYTEK DOES NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BYTEK, ITS AFFILIATES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO FLOWDRAW OR THESE TERMS, EVEN IF BYTEK HAS BEEN ADVISED OF THE POSSIBILITY. BYTEK'S TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO BYTEK IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) USD 100.

13. Indemnification

You agree to defend, indemnify, and hold harmless Bytek and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of or related to your (a) use of FlowDraw, (b) User Content, or (c) breach of these Terms.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or FlowDraw shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to their personal jurisdiction. We both waive jury trial.

15. Changes to Terms

We may update these Terms from time to time. We will post the revised version and update the "Effective Date." Changes become effective on posting. Continued use after changes means acceptance of the revised Terms.

16. Beta Features

We may label certain features as beta, preview, or experimental. Those features are provided "AS IS," may be discontinued at any time, and may contain errors. Use them at your own risk.

17. Feedback

If you provide ideas, suggestions, or feedback, you grant Bytek a perpetual, irrevocable, royalty-free license to use and incorporate it without any obligation to you.

18. Export Compliance

You agree to comply with all applicable export control and sanctions laws and not to export or re-export FlowDraw or related data in violation of such laws.

19. Entire Agreement & Severability

These Terms constitute the entire agreement between you and Bytek regarding FlowDraw and supersede all prior agreements. If any provision is found unenforceable, the remaining provisions remain in full force.
